This Privacy Policy (“Policy”) describes how POP Fitness (the “Company,” “we,” “us,” or “our”) collects, accesses, uses, and discloses your personal information. When you visit our website www.popfitness.ca, mobile application, and use our services, you trust us with your personal information.  We take your privacy seriously.  In this privacy notice we describe our privacy policy.  We seek to explain to you in the clearest way possible what information we collect, how we use it, and what rights you have in relation to it.  We hope you take some time to read it through carefully.

 

This privacy policy applies to all information collected through our website and mobile application (“Apps”) and/or any related services, sales, marketing, or events (“Sites”).  This Privacy Policy does not address the data management and information usage practices and policies of other sites to which the Site may link to or on which a POP Fitness widget may be installed.

 

By using our site, you are accepting and consenting to the practices described in this policy, as updated and amended from time to time.  If there are any terms in this privacy policy you do not agree with, please stop using the site immediately, do not provide us with any information and do not use our services.

 

1. What Information Does POP Fitness Collect?

 

Personal information you disclose to us. 

In short:  We collect personal information that you voluntarily provide to us such as name, address, contact information, passwords, security data, and payment information.

 

The personal information we collect depends upon how you interact with us through the Site. We offer some services and content that do not require you to register for an account or provide any personal information to us. For example, you can read materials such as our blogs without providing personal information.

 

We do not collect any personally identifiable information about you unless you voluntarily submit such information to us. Thus, when you register for any of our programs or otherwise create an account with us through www.popfitness.ca, you provide us with your name, postal address, telephone number, and e-mail address.

 

The personal information we collect can include the following:

 

Name and Contact Data.  We collect your first and last name, email address, postal address, phone number, and other similar contact data.

 

Credentials.  We collect passwords, password hints, and similar security information used for authentication and account access.

 

Payment Data.  All payment data is stored by our payment processor (PayPal) and you should review its privacy policies and contact the payment processor directly to respond to your questions or concerns.

 

All personal information you provide to us must be true, complete, and accurate; and you must notify us of any changes to your personal information.

 

Information Automatically Collected

In short:  Some information – such as IP address and/or browser and device characteristics – is collected automatically when you visit our Sites or Apps.

 

We automatically collect certain information when you visit, use, or navigate the Sites or Apps. This information does not reveal specific identity (such as name or contact information) but may include device and usage information, such as your IP address, browser, device characteristics, operating system, language preferences, referring URLs, device name, country, location information about how and when you use our Sites or Apps, and other technical information. This information is primarily needed to maintain the security and operation of our Sites or Apps, and for our internal analytics and reporting purposes.

 

Like many businesses we also collect information through cookies and similar technologies.

 

Other Internet Technology. We may use other technology, such as pixel tags and web beacons, which are invisible graphics on a web page or email that are programmed to collect non-personally identifiable information about the use of a given website or newsletter, such as whether or not an email is opened and viewed. We may include web beacons and/or pixel tags in email messages, newsletters, or other communications to track use of our Site and determine whether messages have been opened and acted upon.

 

Google Analytics. We have implemented certain Google Analytics Advertising Features. Google Analytics helps us analyze a user’s behavior on our Site and what online channels they used to find the Site. We then can create audiences based on users’ behavior on the Site to send them relevant advertising.

 

Social Media. We collect information from social media platforms and networks that you use in connection with our website or mobile application, or that share or allow you to share information with us, such as Facebook, Twitter, Pinterest, and Instagram. For example, if you use functionalities, plugins, widgets, or tools from social media platforms or networks in connection with our website or mobile application (e.g., to log into an account, or to share inspiration, finds, purchases, and other content with your friends and followers on social media), we will collect the information that you share with us, or that those social media platforms or networks share with us. For more information about social media platform and network privacy practices, please review the privacy policies and settings of the social media platforms and networks that you use. We will not, however, post to social sites as a default or spam your social media connections.

 

Children. We require an individual to be at least eighteen (18) years old to use our Site.  This Site is not directed toward children under 13 years of age, nor do we knowingly collect information about children under 13.  If you are under 13 years of age, you are not permitted to submit personal information to us.  If we find out you are under 13 years of age, we will immediately, upon notice, cancel your account and delete all of your information.  If a parent becomes aware any of his/her children has submitted information to us, please immediately notify us at info@popfitness.ca

 

By using the Site, you consent to us collecting your information as set forth in this Privacy Policy.

 

2. How Do We Use Your Personal Information?

In short:  We process your information for the purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, customize content, and improve the design and performance of the Site.

 

More specifically, we use personal and other information to do things like:

  • To fulfill, manage, and process your orders.

  • To facilitate account creation and logon process with your consent. If you choose to link your account with us to a third party account (such as Google or Facebook), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process.

  • To send you marketing and promotional communications for Business Purposes.  We may use the personal information you send to us for our marketing purposes (newsletters, giveaways).  You can opt-out of our marketing emails at any time.

  • To send administrative information to you for Business Purposes. We may use your personal information to send you product, service, and new feature information, and/or information about changes to our terms, conditions, and policies.

  • To provide you with services.

  • To post testimonials with your Consent.  We post testimonials on our Sites or Apps that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name and testimonial. If you wish to update or delete your testimonial, please contact us at info@popfitness.ca and be sure to include your name, testimonial location, and contact information.

  • To administer prize draws and competitions for our Business Purposes when you elect to participate.

  • Request feedback for our Business Purposes.  We may use your information to request feedback and to contact you about your use of our Sites or Apps.

  • To communicate with you generally, to respond to an inquiry from you, to provide you with services (e.g., to send you a link to a video), to provide you with updates or information concerning our services.

  • To enforce our terms, conditions, and policies.

  • To protect our Sites for Business Purposes and/or for legal reasons.  We may use your personal information to keep our Sites or Apps safe and secure.

  • To respond to legal requests and prevent harm for legal reasons.

  • To allow you to participate in any interactive features of our Site, when you choose to do so.

  • For other business purposes.  We may use your information for other business purposes such as data analysis, identifying trends, determining the effectiveness of our promotional campaigns, and to evaluate and improve our Sites or Apps, products, services, marketing, and your experience.

 

By using the Site, you consent to us using your information as set forth in this Privacy Policy.

 

3. Will Your Information Be Shared With Anyone?

In short: We only share information with your consent, to comply with laws, to protect your rights, or to fulfill business obligations.

Compliance with Laws.  We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or subpoena.

 

Vital Interests and Legal Rights.  We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any persona and illegal activities, or as evidence in litigation in which we are involved.

 

Service Providers. We may share personal information with third parties who perform services on our behalf and require access to such information to do that work.  Examples may include: payment processing, data analysis, email delivery, web hosting services, customer service and marketing efforts.  Unless described in this policy, we do not share, sell, rent, or trade any of your information with third parties for their promotional purposes.

 

With your Consent.  We may disclose your personal information for any other purpose with your consent.

 

By using the Site, you consent to us providing your information to third parties that assist us in the operation and delivery of our Site, products and services. We will take reasonable steps to require any such third parties to comply with the terms of this Privacy Policy.

4. Do We Use Cookies And Other Tracking Technologies?

In short: We may use cookies and other tracking technologies to collect and store your information.

 

We may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information.

 

What are cookies? Cookies are small pieces of instruction stored on your hard drive or device (e.g., tablet or mobile device), not on our Site. Cookies provide us with information that we use to enhance your experience on the Site.

 

Why do we use cookies? We use cookies to collect information, on an aggregate basis, whether users are clicking on links or engaging with us. 5. What Are Your Privacy Rights?

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time.  Please note however that this will not affect the lawfulness of the processing before its withdrawal.

 

If you are a resident in the European Economic Area and you believe we are unlawfully processing your personal information, you have the right to complain to your local data protection supervisory authority. You have the following rights as to your information: the right to access it; the right to modify it; the right to have it deleted (if it is not required to be retained by law or for legitimate business purposes); and the right to opt out. More specifically:

 

Reviewing, Updating, Opting Out, and Deleting Your Information. If you have an account with us, you may review and update your account information (such as your name and contact information) online by making the appropriate selections. You may opt out of email mailings by using the link in the bottom of any email communication, or by writing us at info@popfitness.ca. Please note that opting out of email does not cancel your online billing if you have a subscription with us or automatically deactivate your account. You may also deactivate your account and request that we delete your information by making the appropriate selections. You can also contact us at info@popfitness.ca

Please note that:

  • To protect your privacy and security, we will take reasonable steps to verify your identity before granting access or permitting the requested changes or modifications to be made. Unfortunately, we cannot always ensure that such changes or modifications will be reflected in all iterations of your information as previously stored.

  • We make good faith efforts to provide you with access to your personal information and the ability to correct the information if it is inaccurate or to delete it at your request (if it is not required to be retained by law or for legitimate business purposes). We may decline to process requests that we believe in good faith are unreasonable or unduly burdensome (such as requests that are repetitive, require disproportionate technical effort, jeopardize the privacy of others, or would be impractical to satisfy).

 

Deactivating Your Account. You may deactivate your account with us at any time by making the appropriate selections and contacting us at info@popfitness.ca. If you deactivate your account and later wish to reactivate it and again purchase programs or plans from us, you will have to create a new account. If you deactivate your account, we may retain certain information associated with your account for record keeping and legal compliance purposes.

 

Deleting Your Personal Information.  Again, you can request that we delete your personal information at any time by contacting us at info@popfitness.ca and we will follow through on your request unless we are required to keep your information by law or for legitimate business purposes.  Please note that any information we receive through Google Analytics is deleted twenty-six months after we receive the information.  

 

6. Do We Make Updates To This Policy?

In short:  Yes, we will update this policy as necessary to stay compliant with relevant laws.

 

We may update this privacy policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible.  If we make material changes to this privacy policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. By continuing to use the Site subsequent to us making available an amended version of this Policy, you thereby acknowledge, agree and consent to such amendment.  

 

7. Security and Storage

We do not store your personal information on our own servers but, instead, use third parties, who take commercially reasonable steps to safeguard and deter unauthorized access to your information. In this regard, access to this information is authorized only for those who have a business need for such access. When your information is deleted, we will do so consistent with any applicable legal requirements. Please know that no e-commerce platform, application, website, electronic database or other format or system is completely secure. Moreover, no data transmission over the Internet is completely secure nor can any be guaranteed to be totally secure, and, for this reason, we cannot ensure or warrant the security of any information that you transmit. Therefore, we cannot guarantee that safeguards employed will prevent the disclosure of your information.

 

You can help protect your personally identifiable information by using a combination of letters, numbers and characters in your password, changing your password often, using a secure web browser, and signing off our Site when you are finished with its use.

8. Third Party Websites

The Site contains links to other applications and/or websites. We are not responsible for the privacy practices or the content of such third party services. When you submit information or data to third parties, their privacy policies, not ours, will govern their use of your information and data. You should review the privacy policies and terms of service of all such third parties. We do not make any representations regarding the policies or practices of those third parties.

 

9. Laws in Other Countries

We comply with the Canadian privacy laws and regulations. We do not represent that the Site is governed by, or operated in accordance with, the laws of other nations or jurisdictions, or that the Site or any portion of it is appropriate or available for use in any particular location. If you choose to access the Site, you do so at your own risk, and you are responsible for complying with all local laws, rules and regulations. By using the Site, visitors to the Site from outside of Canada acknowledge and agree that our Site is subject to Canadian laws and regulations, and waive any claims against us that may arise under their own national laws.
